What’s the Problem?
February 13, 2017 - The U.S. Food & Drug Administration issued a recall for the Stryker V40 in August 2016 after being linked to high rates of failure leading to the following complications:
- Disassociation of the femoral head from the hip stem
- Implant fractures
- Increased metallic debris in the body
- Insufficient range of movement
- Loss of mobility
- Adverse local tissue reaction
- Joint instability
- Broken bones around the components
- Leg length discrepancy
- Need for revision surgery
The MCL request follows a bid for multidistrict litigation (MDL) status last month by the U.S. Judicial Panel on Multidistrict Litigation (JPML).
Plaintiffs lawyers are seeking Bergen County, New Jersey, as the jurisdiction for the Stryker LFIT litigation, where at least 25 cases are currently pending. Court records indicate that filings have recently increased, with at least 85 cases filed in courts across the U.S.
JPML is scheduled March 30 to decide on an application to consolidate all federal Stryker V40 lawsuits, with one request seeking the District of Massachusetts as the venue for the litigation.
The MDL application is based on 6 cases filed in 3 districts, but plaintiffs lawyers expect this number to increase greatly in the coming weeks and months.
Bergen County was proposed as the litigation venue because Stryker is based in the county, with headquarters in Mahwah. Plaintiffs have voiced concerns about finding an impartial jury pool in Bergen County, given the presence of Stryker there, but its headquarters are more than 20 miles from the Hackensack courthouse and close to the New York border.
