The grieving son of a South Carolina woman who recently died of uterine cancer after undergoing fibroid removal surgery with a Storz power morcellator has filed a personal injury and wrongful death lawsuit against several defendants, alleging unreasonable misconduct and the failure to adequately warn of the dangers associated with morcellation.

Morcellator Lawsuit Alleges Wrongful Death
The lawsuit, which was filed April 10, 2015 in South Carolina federal court, alleges a number of factual assertions pointing to the Storz Morcellator as the cause of the victim’s death. In May 2011, the woman underwent surgery to remove fibroid tissue that was developing on her uterus and broad ligament. The surgeon performed a supra-cervical and bilateral salpingo-oophorectomy with the Storz Morcellator, according to the complaint.
The plaintiff alleges that the power morcellator caused cancerous tissue to be spread into his mother’s abdomen, leading to a diagnosis of adenosarcoma and sarcomatous overgrowth just 6 days after the surgery. The victim died from cancer complications on April 13, 2012.
Causes of Action
The lawsuit alleges that the manufacturer of the Storz Morcellator failed to adequately warn patients and practitioners of the dangers of power morcellation when used to remove uterine fibroids. Furthermore, the plaintiff contends that if the surgeon would not have used the power morcellator, the decedent’s cancer would have remained “well-confined to the uterus, ovaries and fallopian tubes,” and would not have spread into her abdomen.
The complaint names Karl Storz Endoscopy-America, Inc., Karl Storz Endovision, Inc., and Karl Storz GMBH & Co. KG as defendants. Plaintiff seeks compensation for medical expenses, lost wages, and conscious pain and suffering experienced by the victim prior to her death, which occurred just one year after her surgery.
