Judge Orders Bayer to Begin Settlement Negotiations with Plaintiffs in Roundup Lawsuits

April 18, 2019 – The judge overseeing the multidistrict litigation (MDL 2741) created to handle lawsuits alleging cancer from Roundup weed killer has instructed Bayer AG to pursue mediation with plaintiffs, asking the company to settle as many of the thousands of cases pending against it before they reach the trial phase.

There are currently more than 11,200 lawsuits pending against Bayer AG, which bought out Monsanto last September for $63 billion, and the company has lost 2 straight bellwether trials in a row. Bellwether trials are used as a sort of gauge in complex litigation where a large number of lawsuits are filed citing similar allegations against a common defendant.

What’s the problem?

“The parties should propose a mediator,” U.S. District Judge Vince Chhabria wrote in an order on Thursday. “If they cannot agree, the court will appoint someone.”

Chhabria said that in lieu of the cancelled trial, resources are better spent organizing the caseload pending in the litigation. This entails determining which of the complaints should be dismissed, which should be sent to state courts, and remanding other cases to their original jurisdiction.

Roundup and Cancer

Concerns about the safety of Roundup have surrounded the herbicide for decades. Those fears were sustained after the World Health Organization in 2015 declared that glyphosate was ‘probably carcinogenic’ to humans. In September 2016, a panel of judges consolidated all federal lawsuits alleging cancer from Roundup into MDL No. 2741 in the Northern District of California. The complaints allege that Monsanto knew or should have known that exposure to glyphosate may increase the risk of non-Hodgkin lymphoma and other types of cancer.
