What’s the Problem?
September 16, 2016 – According to the lawsuit, Plaintiff Anthony Harris used Roundup herbicide extensively on his home garden in San Diego, California. The complaint states that Roundup contains glyphosate, a chemical that Monsanto calls safe but has also been classified as “probably carcinogenic to humans” by the World Health Organization (WHO). In 2015, Harris was diagnosed with non-Hodgkin’s lymphoma, a type of cancer that begins in the lymphatic system, that he and his wife believe was caused by his use of Roundup.
Plaintiffs hold Monsanto and other unnamed defendants responsible because they allegedly:
- Failed to adequately warn of the potential health risks involved with using Roundup;
- Failed to manufacture Roundup so as to ensure safety, and
- Failed to protect consumers by introducing a dangerous and/or defective product to the marketplace.
The complaint was filed on September 8, 2016, in the U.S. District Court for the Southern District of California. Plaintiffs bring counts of design defect and failure to warn against Monsanto and other unnamed defendants. They seek a jury trial and judgement in their favor, damages, interest, attorneys’ fees, costs of proceedings and any other relief the court deems just.
