The suit, filed on behalf of 70-year-old Plaintiff Edward Hardeman, is just the second of more than 11,000 similar complaints brought by people who claim they got cancer from Monsanto Roundup herbicide, which is now owned by Bayer AG, who acquired Monsanto last June for about $63 billion.

What’s the problem?
During the trial, experts for the prosecution presented evidence that glyphosate, the active ingredient in Roundup, increases the risk that users of the herbicide and those who spend significant time around it will develop cancer. This evidence came in the form of animal studies, mechanistic data and epidemiologic statistics.
The case is different from the first, which concluded last August with the plaintiff awarded $289 million in damages, in that U.S. District Court Judge Vince Chhabria bifurcated the trial into 2 phases: the first involving scientific evidence, and the second concerning allegations of wrongdoing by Monsanto representatives.
If the 6-person jury determines the evidence shows Roundup was a “substantial factor” in contributing to Hardeman’s development of non-Hodgkin lymphoma, the trial will proceed to a second phase to cover questions of what Monsanto knew, how the company conducted itself, and potential damages. If the jury finds Roundup wasn’t the cause of his cancer, the trial will end with a victory for the defense. If jurors are unable to reach a verdict, the result would be a mistrial, and the case could be heard again.
