Roundup and Cancer

A person in a hospital bed with a family relative holding their handMonsanto placed Roundup on the market in 1973, and it is one of the most popular herbicides in the world. Although 28 countries ban the sale of this product, it is still legal and in use throughout most of the United States [2].

The main active ingredient in Roundup is glyphosate, which was initially developed as a water softener and pipe cleaner. Glyphosate kills plants by inhibiting their ability to produce amino acids, which are essential for plant growth.

After reviewing the scientific evidence, the International Agency for Research in the World Health Organization classified glyphosate as a Group 2A carcinogen, meaning it is “probably carcinogenic to humans.”

The U.S. Environmental Protection Agency has not yet tied glyphosate to non-Hodgkin’s lymphoma. However, they have not come out against class action and multi-district litigation.

This means that Bayer had a duty to warn consumers that their product could produce serious health problems and be dangerous to human life.

How to Qualify for a Lawsuit?

In order to qualify for Roundup cancer lawsuits in Arizona, you or a loved one must have used the product as directed on the label and have a cancer diagnosis of non-Hodgkin’s Lymphoma (NHL) or certain other blood cancers.

Some of those other cancers include:

Further, a regular user of this popular weed killer may be more likely to have developed cancer than someone who only uses the product occasionally. Most plaintiffs have used this probably human carcinogen as part of their employment in a setting such as farm work, groundskeeping, landscaping, or gardening.

“Monsanto’s conduct evidenced reckless disregard of the health and safety of the multitude of unsuspecting consumers it kept in the dark.” - 1st Appellate District in the Court of Appeal for California

In order for Arizona Roundup lawyers to file these lawsuits, there are specific criteria that must be met.

First and foremost, you must show that you were actually exposed to the herbicide. You can prove this through medical records, eyewitness testimony, or photographic evidence.

Furthermore, you need to demonstrate that exposure to Roundup was the proximate cause of your injuries. In other words, there must be a direct causal link between your injuries and the herbicide.

Finally, you must prove that you have suffered some form of damage because of your injuries. These harms can include medical bills, lost wages, pain, and suffering, or other types of damages.

Statute of Limitations

A lawyer looking through a law bookOne of the first steps in filing any personal injury lawsuit is to make sure you file within the statute of limitations. The statute of limitations is the time limit set by law within which you can file a lawsuit.

This time limit varies from state to state and can also depend on the type of case you’re bringing. For example, in Arizona, the statute of limitations for most personal injury cases is two years.

Unfortunately, if you miss the deadline to file your lawsuit, the law will probably bar you from recovering any compensation for your injuries. So even if you have a strong claim, it will be tough to win your case if you wait too long to take action.

In most cases, the clock starts when the injury occurs. But sometimes, the timeline doesn’t begin until the person discovers their injury.

So if a doctor has diagnosed you or someone you know with cancer after using Roundup, don’t wait to contact us. The sooner you act, the better your chances of success.

How Much Can You Recover in a Lawsuit?

A lawyer stamping paperworkBayer has paid out over 11 billion dollars in verdicts and settlements in Roundup cancer lawsuits [3]. The first lawsuit against Bayer was decided in 2018, with the plaintiff winning $289 million, and since then, the company has lost several key Roundup cases.

For example, in one subsequent case, a jury awarded a couple $2 billion after finding that their regular use of Roundup caused them to develop cancer and Monsanto failed to warn them about the danger of glyphosate-based herbicides

In another particular case, a jury found that a man should get $80 million for medical costs and punitive damages after finding that Roundup was a probable carcinogen and a substantial factor in causing his health problems.

We will pursue all available compensation for your losses, which may include:

  1. Medical expenses
  2. Financial loss and decreased earning capacity
  3. Pain and suffering
  4. Emotional distress
  5. Wrongful death damages
  6. Punitive damages
