What’s the Problem?
May 13, 2016 – According to the lawsuit, all 4 plaintiffs — Larry Domina, Frank Pollard, Robert Dickey and Royce Janzen — allege they developed non-Hodgkins lymphoma as a direct result of using Roundup herbicide year after year. They also claim Monsanto mislabeled the weed killer despite the “body of recognized scientific evidence linking the disease to exposure to Roundup.”
The World Health Organization’s International Agency for Research on Cancer (IARC) has classified glyphosate as “probably carcinogenic to humans;” however, Monsanto markets the herbicide as “safe enough to drink.” In response, California last year became the first state in the U.S. to classify Roundup as a carcinogen; Monsanto countered by suing the state to fight the designation.
According to the IARC, cancers linked to glyphosate exposure include NHL, lymphocytic lymphoma / chronic lymphocytic leukemia, B-cell lymphoma and multiple myeloma.
Monsanto is the world’s leading producer of glyphosate. The company generated nearly $5 billion in sales from Roundup last year alone. The weed killer is sprayed on “Roundup-ready” crops which are genetically modified to resist it.
Widely available for home use, Roundup is used in commercial agriculture on more than 100 types of crops. Over 85 million pounds of glyphosate was sprayed on U.S. crops in 2001, which more than doubled to 185 million pounds by 2007.
“Glyphosate is found in rivers, streams, and groundwater in agricultural areas where Roundup is used,” the complaint states. “It has been found in food, the urine of exposed persons, and in the urine of urban dwellers without direct contact with glyphosate.”
Plaintiffs seek punitive damages for defective design, failure to warn, negligence and breach of warranty.
