What’s the Problem?
March 28, 2017 – The lawsuit would have been the 7th case to go before a jury in the Risperdal mass tort program in Philadelphia’s Court of Common Pleas, according to Law360.
Judge Arnold New last month issued an order granting summary judgment in favor of Janssen Pharmaceuticals Inc., a division of Johnson & Johnson and the manufacturer of Risperdal.
Risperdal was approved by the U.S. Food & Drug Administration (FDA) in 1993 for the short-term treatment of adults with schizophrenia. Its approval was later expanded to include pediatric uses including irritability associated with autism and short-term treatment of bipolar disorder.
In 1999, a study published in the Journal of Clinical Psychopharmacology warned about the use of Risperdal in children:
“Risperidone administered to adolescents at doses commonly used for the treatment of psychotic symptoms can strongly increase prolactin levels, with clinical consequences such as gynecomastia and/or galactorrhea. Given that the long-term effects of antipsychotic drug-induced hyperprolactinemia are not well documented, especially regarding osteopenia, infertility, growth, and pubertal delay, risperidone should be administered with caution to children and adolescents.”
Plaintiff in the recently dismissed lawsuit was 8-years-old when he started taking Risperdal to treat the symptoms of ADHD.
Judge New based his decision to drop the case on Janssen’s argument that testimony from the plaintiff’s prescribing physician did not satisfy the learned intermediary doctrine, which requires proof that a different warning would have changed the treatment regimen.
The doctor reportedly testified that he would’ve never considered Risperdal had he known of its potential to cause gynecomastia. However, another doctor testified that she would have continued to prescribe the drug because the potential benefits outweighed the risks.
The case is P.D. et al. v. Janssen Pharmaceuticals Inc., Case No. 130600738, in the Court of Common Pleas of Philadelphia County, Pennsylvania.
