J&J Settles Arkansas Risperdal Lawsuit for $7.8 Million

What’s the Problem?

June 9, 2015 – The Arkansas Attorney General moved to dismiss the lawsuit last month as part of the accord, according to court records. The settlement amounts to a small fraction of the $1.2 billion fine J&J and Janssen were assessed in Apr. 2012, after a Pulaski County jury found that the companies had violated state laws governing Medicaid fraud and deceptive trade practice by illegally marketing Risperdal; however, the verdict was later overturned by the Arkansas Supreme Court. The case is: (State of Arkansas v. Ortho-McNeil-Janssen Pharmaceuticals Inc., CV07-15345).

Gynecomastia Litigation

There are currently more than 1,300 Risperdal lawsuits pending against Janssen and J&J in the Philadelphia Court of Common Please. Plaintiffs allege the companies illegally marketed Risperdal for unapproved uses, and concealed risks including gynecomastia and other serious side effects (In Re: Risperdal Litigation, Case Number 100300296).

Bellwether Trials

Court records indicate that the Risperdal litigation is currently in the process of a bellwether trial program involving gynecomastia lawsuits. Last week, an undisclosed settlement was reached in the case selected for the 3rd bellwether trial (Case No. 130301812). The 1st trial concluded Feb. 24, with the jury awarding $2.5 million to an autistic man who developed gynecomastia after taking Risperdal as a child (Case No. A-196444). The 2nd trial ended Mar. 20, with the jury finding that Risperdal’s warnings about male breast growth were inadequate. However, the plaintiff was not awarded compensation because the jury felt he hadn’t proven conclusively that Risperdal caused his condition (Case No. 130301803). A 4th bellwether trial is set to begin Jun. 22 (Case No. 130401984).
