Janssen Pharmaceuticals has settled another products liability lawsuit alleging gynecomastia from the antipsychotic drug Risperdal (generic: risperidone) before what would have been the seventh such case to go to trial.

What’s the problem?
January 11, 2017 – Plaintiff in the settled lawsuit is Zachary Sabol, who filed his case in the Philadelphia Court of Common Pleas in April 2013. Sabol alleged he developed gynecomastia after taking Risperdal for about a decade.
FDA approved Risperdal in October 2006, and eventually required a label change to warn of a potential 2.3% risk for the development of abnormal breast growth in adolescents.
Sabol argued that he was prescribed Risperdal before the drug had been approved for use in adolescents. At the time, Risperdal was associated with only a rare occurrence of gynecomastia, with fewer than one in 1,000 patients affected.
The trial was scheduled to begin January 9. The confidential settlement was announced three days earlier. The lawsuit is: Zachary Sabol et al. v. Janssen Pharmaceuticals Inc. et al., Case No. 130402100, in the Court of Common Pleas of Philadelphia County, Pennsylvania.
Plaintiffs have won 4 of 7 Risperdal gynecomastia lawsuits thus far, with Janssen coming out victorious in 2 cases. The company earned a defense verdict in March 2015, followed by a rare mid-trial dismissal this past December, after a judge found insufficient evidence of causation submitted by the plaintiffs.
There are still about 2,300 lawsuits pending in Philadelphia’s mass tort program filed on behalf of boys and young men who allegedly developed abnormal breast growth after taking Risperdal.
