Lawsuits filed by plaintiffs alleging injuries from a class of heartburn medications known as proton pump inhibitors (PPIs) have been consolidated in New Jersey federal court for pretrial handling by a single judge.

What’s the Problem?
August 4, 2017 – According to a Transfer Order (PDF) issued Wednesday by the U.S. Judicial Panel on Multidistrict Litigation (JPML), at least 161 PPI kidney damage lawsuits will initially be transferred to the District of New Jersey for pretrial coordination. Another 2 dozen claims may be eligible for transfer to the new proceeding, as are any similar claims filed in the future, the panel said.
PPI heartburn drugs include:
- Nexium (esomeprazole magnesium)
- Aciphex (rabeprazole)
- Protonix (pantoprazole)
- Prevacid (lansoprazole)
- Zegerid (omeprazole / sodium bicarbonate)
- Dexilant (dexlansoprazole)
- Prilosec (omeprazole)
- Vimovo (esomeprazole and naproxen)
Plaintiffs allege that PPI manufacturers have known for years that their products have the potential to injure the kidneys, yet failed to issue a recall or even adequately warn the public. They further claim that their injuries of chronic kidney disease (CKD), kidney failure, and other renal side effects could have been avoided had proper warnings been issued.
Earlier this year, JPML denied a motion seeking consolidation of PPI kidney disease lawsuits. The Panel noted only about 15 such filings, as well as the large number of medications in the PPI class whose manufacturers would need to protect trade secrets throughout the litigation process.
In agreeing to centralize the claims, JPML noted that the size of the litigation had grown. Two defendants, AstraZeneca and Pfizer, had also changed course and now supported the MDL.
