In what appears to be the latest in a wave of similar litigation, a New York man has filed a Propecia lawsuit against pharmaceutical giant Merck, alleging that the drug caused him persistent sexual side effects. The plaintiff claims that although he stopped using Propecia, his complications have not gone away, and that he is still suffering from severe sexual dysfunction and cognitive impairment, which is causing him pain and suffering, as well as a significantly diminished quality of life. Sadly, the plaintiff’s situation is not uncommon, as former Propecia users around the country continue to file lawsuits against Merck after being injured by Propecia side effects.

What’s the problem?
Like many young men, 22-year-old Michael Cali noticed that he was beginning to lose his hair. Desperate to do anything he could to reverse the trend, Cali went to his doctor and got a prescription for Merck’s blockbuster hair-loss treatment Propecia (generic: finasteride). But after using the drug for a short time, Cali began losing something other than his hair: he was losing his ability to function sexually, and suffering from prolonged bouts of unexplained cognitive impairment. Because of these debilitating long-term complications, Cali decided to file a Propecia lawsuit against Merck on June 22, 2012, in the U.S. District Court for the Eastern District of New York.
Although Propecia warning labels originally stated that sexual side effects were rare and temporary, mounting research and numerous case studies have found this claim not to be true, and that some complications can persist for months or even years after users discontinue treatment with the drug. In severe cases, Propecia’s sexual side effects may even be permanent.
In addition to erectile dysfunction (ED), impotence, and cognitive impairment, Propecia has also recently been linked to decreased sperm count, testicular pain, reduced sex drive, body disfigurement, and male breast cancer. In April 2012, a Propecia multidistrict litigation (MDL) was formed in the Eastern District of New York under U.S. District Judge John Gleeson.
Cali’s lawsuit charges Merck with:
- strict liability
- breach of express
- implied warranties
- violation of unfair and deceptive trade practice acts
- negligent infliction of emotional distress
The complaint also states that the “wanton, willful, fraudulent, reckless acts” of the defendants displayed “complete regard and reckless indifference for the safety and welfare of [the Plaintiff].”
Cali is seeking compensatory damages for his injuries, plus special, punitive and/or exemplary damages.
