The complaint alleges that Propecia and Proscar, which contain the active ingredient finasteride, cause an “increased risk of persistent and/or serious and dangerous side effects.” Complications associated with these drugs include cognitive impairment, depression, erectile dysfunction, reduced libido, reduced sensation and infertility.

What’s the problem?

On January 27th, 2012, St. Louis resident Adam Keune and more than 50 other plaintiffs from 22 states filed a consolidated complaint in St. Louis Circuit Court against the following entities:

  • Merck & Co. Inc.
  • Merck Harpe
  • The Dohme Corporation

Each of the plaintiffs claim they or their husbands used finasteride-containing prescription drugs to treat male pattern baldness. According to the complaints, finasteride causes and increased risk of persistent dangerous side effects. The complaint lists these side effects as:

  • cognitive impairment
  • depression
  • erectile dysfunction
  • reduced libido
  • reduced sensation
  • infertility

The complaint alleges these side effects persist even after the patient stops taking the drug.

Law firms representing the plaintiffs say Merck and its subsidiaries manufactured these drugs under the names Propecia, Proscar, and generic finasteride. The lawsuit alleges that finasteride reacts with testosterone and converts to another chemical that is designed to shrink hair follicles and prevent hair loss.

“The rates of sexual dysfunction as a result of finasteride are reported to be as high as 39% in published clinical studies,” the complaint reads. It goes on to state that only about half of these patients’ side effects were resolved after discontinuing the medication. It has been estimated that more than a million men take finasteride-containing drugs and are unaware of the potential long-term complications.

In other countries, warning labels for Propecia and Proscar contain information about sexual side effects, but the same verbiage is not found on drug labels sold in the U.S. The complaint alleges that Merck knowingly and actively hid the truth about their drug’s side effects, and that the company was negligent for creating a dangerous drug and marketing it to patients without conveying the risk of possible complications.

The complaint accuses Merck and its subsidiaries of:

  • fraudulent concealment
  • strict liability
  • negligence
  • breach of express warranty
  • negligent infliction of emotional distress
  • loss of consortium

The wives of the alleged victims say they too were damaged by Merck’s actions and the medications’ effects on their husbands. The plaintiffs are seeking more than $100,000 each for:

  • actual compensation
  • compensatory damages
  • punitive damages
  • court costs
  • interests
