A panel of federal judges is set to decide whether to designate individual Propecia side effects lawsuits for multidistrict litigation (MDL). What’s the problem?
In anticipation of the panel’s ruling, defendant Merck has requested that Propecia side effects lawsuits be transferred to New Jersey for MDL. Other potential venues proposed include New York and Washington State. The decision is scheduled to be made during the next hearing on Propecia MDL, which is set to take place on March 29, 2012 in San Diego, CA.
As long as all Propecia claims filed in federal court involve a common question of fact, they are eligible to be consolidated into MDL for pretrial proceedings. The final decision on the matter will be made by the U.S. Judicial Panel on Multidistrict Litigation. The goal of MDL is to avoid duplicate discovery, prevent inconsistent rulings, and increase judicial efficiency.
