Propecia Lawsuit Settlements

A panel of federal judges is set to decide whether to designate individual Propecia side effects lawsuits for multidistrict litigation.

A panel of federal judges is set to decide whether to designate individual Propecia side effects lawsuits for multidistrict litigation (MDL). If the panel decides in favor of implementing the MDL, each Propecia claim filed on the federal level will be consolidated and transferred to a single courthouse for pretrial proceedings. In recent months, an ever-increasing number of Propecia lawsuits have been filed in courts around the country alleging that the popular hair loss treatment has caused serious sexual side effects and cancer.

What’s the problem?

In anticipation of the panel’s ruling, defendant Merck has requested that Propecia side effects lawsuits be transferred to New Jersey for MDL. Other potential venues proposed include New York and Washington State. The decision is scheduled to be made during the next hearing on Propecia MDL, which is set to take place on March 29, 2012 in San Diego, CA.

As long as all Propecia claims filed in federal court involve a common question of fact, they are eligible to be consolidated into MDL for pretrial proceedings. The final decision on the matter will be made by the U.S. Judicial Panel on Multidistrict Litigation. The goal of MDL is to avoid duplicate discovery, prevent inconsistent rulings, and increase judicial efficiency.

A growing number of men around the country have been pursuing compensation through a Propecia lawsuit. In addition to the numerous cases filed in federal courts, a number of other claims have been filed in various state courts. The central question posed by Propecia litigation is: How many men, if they had been adequately informed of the potential side effects, would trade sexual dysfunction for a fuller head of hair?

Propecia Website Removed Amid Concerns Over Side Effects

The controversy surrounding Propecia’s side effects may have led Merck to pull its content from the company’s website. Although Merck has offered no explanation for the move, many have speculated that it might have something to do with the growing number of Propecia side effects lawsuits filed against the company in recent months. Most of the lawsuits involving Propecia allege that Merck knew – or should have known – about the serious side effects associated with its drug, and that it failed to adequately warn consumers of these inherent risks.
