What’s the problem?
June 28, 2012 – The original petition to consolidate the Pradaxa internal bleeding lawsuits was filed last month on behalf of plaintiff Vera Lee Sellers. The request called for the cases to be transferred to U.S. District Judge David R. Herndon in the Southern District of Illinois, who recently oversaw the federal Yaz and Yasmin litigation.
In a formal response filed last week, Boehringer indicated that it fully supports Sellers’ proposed multidistrict litigation for the Pradaxa cases. MDLs are designed to reduce duplicative discovery, eliminate conflicting pretrial rulings from different judges, and to serve the convenience of all parties involved. Yet despite Boehringer’s willingness to comply with the consolidation, the company disagrees about where the cases should be sent.
Boehringer has asked that the Pradaxa MDL be centralized in the District of Connecticut, which is where the company’s corporate headquarters are located, and where the vast majority of the relevant documents, witnesses and parties common to all lawsuits are located. The U.S. Judicial Panel on Multidistrict Litigation (JPML) has set oral arguments on the formation of the Pradaxa MDL to begin July 26, at a hearing to be held at the Carl B. Stokes U.S. Courthouse in Cleveland, Ohio.
MDLs are common in complex pharmaceutical litigation, where a large number of lawsuits are filed involving similar allegations of fact. Although the cases in an MDL are handled in a coordinated manner, unlike class action lawsuits, each claim remains an individual case. In the event that a settlement is not reached or other suitable resolution not attained, the cases are remanded back to the original district where they were filed for individual trial dates.
