What’s the Problem?

February 24, 2017 – Plaintiff in the lawsuit, Matthew Huff, was implanted with Ethicon Physiomesh in 2013 to repair an abdominal wall hernia. Two years after the surgery he was hospitalized after suffering adverse health complications including abdominal pain, fever, chills and redness on his abdomen, according to the complaint.

Surgeons reportedly found an infection around the hernia patch, which had caused significant damage to Huff’s abdomen and intestines. He subsequently developed abdominal abscesses and intestinal fistulas from the mesh and required additional surgery, according to the lawsuit.

Huff originally filed the complaint on April 1, 2016, accusing Ethicon of negligence, strict liability, and breach of warranty. Plaintiff further alleges that the company designed an “unreasonably dangerous” and defective product. He alleged Physiomesh was not adequately tested and said the hernia patch did not meet Ethicon’s usual standards and requirements.

The lawsuit (Case No. 3:16-cv-00368) will be the first Physiomesh lawsuit to go to trial and will be held before District Judge J. Phil Gilbert in the Southern District of Illinois.
