A Louisiana woman who was allegedly injured after receiving a Physiomesh hernia patch has filed a products liability lawsuit against Ethicon Inc. and Johnson & Johnson.

What’s the Problem?
April 17, 2017 – According to the lawsuit, Plaintiff Laura Lutz underwent hernia repair surgery with Physiomesh on June 13, 2012. She claims to have subsequently developed serious injuries which required revision surgery as a result of the allegedly defective medical device.
Lutz holds the defendants responsible for manufacturing and selling a defective medical device, and for failing to adequately warn the public and medical community of the potential health risks of Physiomesh.
Physiomesh is composed of flexible, non-absorbable polypropylene that is designed to repair hernias and other fascial deficiencies. The device was approved by the FDA in April 2010.
In May 2016, Ethicon announced that it had withdrawn Physiomesh from the global market after an analysis of unpublished data found higher than average recurrence and reoperation rates associated with the products. The company was unable to determine the exact cause of the problems but said “possible product characteristics, operative and patient factors” may have played a role.
Lutz is requesting a jury trial and seeking compensatory and punitive damages, as well as attorneys’ fees, costs and such other relief the court deems fit. The complaint was filed on April 4, 2017, in the U.S. District Court for the Eastern District of Louisiana under case number 2:17-cv-02869.
