A man from Pennsylvania who claims he was severely injured after receiving the Physiomesh hernia patch has filed a products liability lawsuit against Johnson & Johnson and its Ethicon unit in the Southern District of New York.

What’s the Problem?
October 25, 2017 – According to the lawsuit, Plaintiff underwent surgery to repair a ventral (abdominal) hernia in February 2013 at the Memorial Hospital in Homesdale, Pennsylvania. The surgeons used a 15 x 20 cm patch of Physiomesh in the procedure, the complaint states.
Physiomesh is designed to work like a patch over the hernia, helping to shore up and support any distended tissues, muscles, or organs. Ethicon submitted a modified version of the Physiomesh (Physiomesh Open) for FDA 510(k) clearance in June 2014. The agency cleared a second model of the Physiomesh in October 2014.
In March 2017, plaintiff was hospitalized after complaining of symptoms including chronic abdominal pain and a bulge in his abdomen, which were characteristic of “eventration” of the mesh. This means that the mesh was protruding through the abdominal wall.
The decision was made to remove the mesh, and the plaintiff was forced to undergo yet another painful and time-consuming surgery. During the procedure, one of the physicians noted “dense omental adhesions to the abdominal wall and the region of the mesh….” and that he had to remove part of the abdominal lining, and actually dissect it to get all of the mesh out.
Plaintiff is seeking compensatory damages for pain and suffering, permanent impairment, and medical care costs, as well as economic damages including past and future wages, lost earnings and/or earning capacity.
