Illinois Man Alleges Complications from Physiomesh Hernia Repair

An Illinois man who says he was injured by the Physiomesh hernia patch has filed a lawsuit against Ethicon and J&J.

A man from Illinois who allegedly had severe health complications following hernia repair surgery with a Physiomesh patch has filed a products liability lawsuit against the manufacturer.

What’s the problem?

May 30, 2017 – According to the lawsuit (PDF), Plaintiff Gary Goodson was implanted with a Physiomesh hernia patch (25CM x 20CM) at Anderson Hospital in Maryville, Illinois. Since the procedure, Goodson claims he has suffered “continuous complications” which have required him to undergo painful revision surgery.

The suit was filed on May 22, 2017, in the U.S. District Court for the Southern District of Illinois under case number 3:17-cv-00540. Plaintiff alleges that Physiomesh was defectively designed and is not suitable for use in hernia repair surgery.

Goodson claims that Physiomesh features a unique multi-layer coating, which is intended to prevent adhesion and inflammation, as well as help incorporate the mesh into the body. However, Plaintiff alleges that this coating creates a “breeding ground for bacteria” and is not strong enough to withstand normal use.

“Instead the multi-layer coating prevented adequate incorporation of the mesh into the body and caused or contributed to an intense inflammatory and chronic foreign body response resulting in an adverse tissue reaction including migration and damage to surrounding tissue in the form of sclerotic, granulomatous and/or fibrotic tissue and improper healing,” the complaint states.

Ethicon is currently resisting a bid by plaintiffs to consolidate all federal lawsuits alleging injuries from Physiomesh into a multidistrict litigation (MDL) for pretrial handling. Defendants argue that each complaint involves individualized facts, citing a wide range of injuries by the plaintiffs, thus making centralization inappropriate.
