Pennsylvania Man Alleges Severe Infection from Stӧckert 3T Heater-Cooler

A Pennsylvania couple alleging a life-threatening infection M. Chimaera infection from a heater-cooler device has filed a lawsuit against the manufacturers.

A married couple from Hanover, Pennsylvania, has filed a products liability lawsuit against LivaNova (formerly Sorin Group Deutschland GMBH), alleging that the company’s Stӧckert 3T heater-cooler unit caused the man to develop a life-threatening M. Chimaera infection.

What’s the Problem?

October 4, 2017 – Plaintiffs Richard Whipkey and Elizabeth Whipkey filed the suit on July 13 in the U.S. District Court for the Middle District of Pennsylvania, according to the Pennsylvania Record. The complaint names Livanova Deutschland GMBH and Sorin Group USA Inc., as defendants, bringing claims of negligence, design defects and other damages.

According to the lawsuit, Mr. Whipkey underwent open-heart surgery in May 2015, and within a year had developed unexplained symptoms that led him to consult his physician. After a series of tests, Whipkey was diagnosed with an M. Chimaera infection, allegedly caused by his exposure to the Stӧckert 3T heater-cooler device.

The FDA in 2015 blocked imports into the U.S. of Stöckert 3T heater-cooler units after issuing a warning letter related to manufacturing violations by LivaNova. The agency didn’t require hospitals to discontinue use of existing devices, though it and the U.S. Centers for Disease Control and Prevention (CDC) have issued new recommendations for reducing the risk of bacterial infections.

The Whipkeys argue that Livanova and Sorin Group are responsible for the injuries because their heater-cooler allegedly colonized bacteria, which was directly transmitted to Richard during invasive surgery.

Plaintiffs are requesting a jury trial, both compensatory and punitive damages, interest, court costs, and any other relief deemed just. The lawsuit is: U.S. District Court for the Middle District of Pennsylvania case number 1:17-cv-01233-JEJ
