October 8, 2013 – A growing number of cases of acute hepatitis linked to the pre-workout dietary supplement OxyElite Pro in Hawaii are being investigated by health authorities, the U.S. Food & Drug Administration (FDA) announced today. To date, the Hawaii Department of Health (DOH) has reported that at least 24 of these cases have been positively associated with OxyElite Pro. In addition to hepatitis, OxyElite Pro has been linked to heart attacks, heat strokes, seizures, liver failure, and death.
OxyElite Pro Lawsuit Update 4/16/14: Earlier this month, a panel of federal judges denied a motion by the makers of OxyElite Pro and Jack3d to transfer and consolidate a number of products liability lawsuits to federal court in Philadelphia. The litigation contends that the supplements contained altered ingredients that were unsafe and unapproved by the FDA, leading to a nationwide hepatitis outbreak. Click here to learn more.

What’s the Problem?
According to a press release issued today by the FDA, there have been at least 29 cases of acute non-viral hepatitis with an unknown cause reported in Hawaii. Eleven of these patients have been hospitalized, two received liver transplants, and one person died as a direct result of their injuries. The Centers for Disease Control and Prevention (CDC) is currently in the process of looking at other cases of liver injury around the country that may have been caused by OxyElite Pro. Signs and symptoms of acute hepatitis typically include varying degrees of:
- loss of appetite
- abdominal pain
- dark urine
- clay or gray-colored bowel movements
- joint pain
- jaundice (yellowish eyes and/or skin)
This ongoing investigation is being conducted by the Hawaii DOH, CDC, and FDA. As part of the investigation, the FDA is reviewing the medical records and histories of the individuals who have been diagnosed with acute hepatitis in Hawaii. The administration is also analyzing OxyElite Pro product samples that have been collected from a number of these patients. Additionally, the FDA is currently in the process of inspecting the facilities involved in manufacturing OxyElite Pro, and reviewing their production and product distribution records. Because USPlabs LLC has informed health authorities that it believes counterfeit versions of OxyElite Pro are being sold in the U.S., and have been on the market for some time, the FDA is also investigating whether counterfeit products may have caused any of the cases of acute hepatitis.
