The U.S. Judicial Panel on Multidistrict Litigation (JPML) issued an Order Friday transferring all such claims to the U.S. District Court, Eastern District of Kentucky, to undergo pretrial handling which will be overseen by the Honorable Karen K. Caldwell.

What’s the problem?
February 5, 2018 – In addition to the claims against Onglyza, the multidistrict litigation (MDL) will contain similar lawsuits alleging heart failure from Kombiglyze XR, another type 2 diabetes medicine which has been linked to the same side effects.
The litigation surrounding the 2 drugs began to mount shortly after the U.S. Food & Drug Administration (FDA) in April 2016 required that new heart failure warnings be added to the labeling of all saxagliptin-containing diabetes medications. The strengthened warnings were issued on the heels of clinical trial data which linked saxagliptin to a 27% increased risk for heart failure, a fatal condition that occurs when the heart can no longer fulfill its normal workload and is unable to pump blood through the body as required.
Saxagliptin was also found to be associated with a higher risk of all-cause mortality, according to the study.
Plaintiffs in the lawsuits allege that manufacturers failed to adequately warn of the heart failure risk with the drugs, and neglected to recall their products when a host of other safer diabetes treatments are widely available.
