What’s the Problem?
August 30, 2016 – According to the lawsuit, plaintiff took Onglyza to treat his type 2 diabetes from April 2015 to June 2015. In July 2015, he suffered a heart attack, which caused him significant injuries, pain and suffering, and loss of earnings and earning capacity, according to the complaint. Plaintiff claims he will continue to require intensive medical treatment in the future as a result of his injuries.
Furthermore, plaintiff alleges that his doctor would not have prescribed him Onglyza had they been adequately warned about the drug’s potential side effects, including the risk of heart failure and related adverse events. He blames Bristol-Myers Squibb and AstraZeneca for failing to provide adequate warnings about these risks on the labeling of Onglyza.
Had the prescribing doctor been aware of these potential health risks, plaintiff claims he would not have have prescribed the medication. Instead, the manufacturers downplayed the risk of adverse events, resulting in the plaintiff unnecessarily suffering from a heart attack.
The lawsuit goes on to note that in addition to failing to adequately study Onglyza for its cardiovascular risks, Bristol-Myers Squibb and AstraZeneca also over-promoted and under-warned about the medication’s benefits and risks in their marketing and advertising materials.
The complaint was filed on July 13, 3016, in the Eastern District of Kentucky. Plaintiff is seeking in excess of $75,000 in damages from the defendants.
