Update: Korean Court Awards Instant Soup Burn Victim Nearly $100,000
February 2, 2018 - A court in Seoul, Korea, has ordered Asiana Airlines and one of its employees to pay a passenger about 100 million won ($93,569) for severely burning her by accidentally pouring instant noodle soup on her during a flight. The passenger, a Korean fashion model who goes by the surname Chang, was flying to Paris from Incheon in a business class seat on March 17, 2014, when the flight attendant spilled the noodle soup, causing second and third-degree burns to her lower body.
What’s the Problem?
Nissin Instant Noodles Soup come in small styrofoam cups of dried noodles, which are then filled with water, heated in a microwave, and eaten right out of the cup. Unfortunately, despite their convenience, Nissin Soup Cups can cause severe burns if they are spilled. In fact, according to a recent story reported on National Public Radio (NPR), most medical centers treat a number of soup burn cases each week, most of them occurring in children and infants.
Dr. Warren Garner, director of the Burn unit at University of Southern California’s County Hospital, has stated that he sees “at least two to three patients a week who’ve been injured by these products.” Garner says young children are at a particular risk of being seriously burned by Nissin Soup Cups, stating that 1 in 5 children admitted to emergency rooms with soup burns require surgery, and that many face permanent disability due to nerve damage.
Why Are Nissin Noodle Soup Cup Burns So Severe?
Once tipped, Nissin Noodle Soup Cups can seriously burn people. The soups are designed to be heated in a microwave to extremely high temperatures. Once hot, the soup cups cool more slowly than water, and the noodles can stick to the skin, causing more severe burns. Studies have shown that, compared to other types of scalding injuries, Nissin Noodles Soup burns result in substantially longer hospital stays. In some cases, children have been hurt so badly by instant soup cups that they were required to be fed through feeding tubes.
Instant Soup Cup Burn Injury Study
The dangers posed by Nissin and other similar instant noodle soup cups were recently the subject of a peer reviewed study published by the National Institutes of Health. Entitled "Instant cup of soup: design flaws increase risk of burns," the study measured the height and base size of a number of popular soup cups, and determined that the height of the cups make them more likely tip over. The research team, which included a group of doctors at the Shriners Burn Hospitals for Children Northern California, University of California, Davis, concluded that simple redesigning of instant soup packaging with wider bases and shorter heights, along with more prominent warnings about the risk of burns on the packaging, would greatly reduce the frequency of instant noodle soup cup burns.
At Schmidt & Clark, LLP, we believe that Nissin and other instant noodle soup cup manufacturers knew - or should have known - about the burn risks associated with their products, yet they chose to continue manufacturing and selling these soups without adequately warning the public. Related studies have concluded that one of the leading causes of burn injuries among children is from hot soup prepackaged in instant cup containers.
