What’s the Problem?
September 14, 2016 – According to the lawsuit, Plaintiff George Mullen took Nexium as prescribed from 2006 to 2013. In 2008, he was diagnosed with chronic kidney disease (CKD), a condition that occurs when the kidneys lose their ability to function over time.
The complaint states that in addition to CKD, plaintiff developed other unspecified serious side effects and personal injury which caused him physical pain, mental anguish, diminished quality of life, as well as monetary expenses resulting from ongoing medical treatment. Mullen claims that AstraZeneca failed to adequately warn about the risk of kidney damage from Nexium despite having knowledge about these dangers.
Plaintiff’s allegation that Nexium caused his CKD was backed by numerous studies which have identified links between the use of proton pump inhibitor (PPI) heartburn drugs and kidney damage. In addition to Nexium, other PPIs include:
- Aciphex (rabeprazole)
- Protonix (pantoprazole)
- Prevacid (lansoprazole)
- Zegerid (omeprazole / sodium bicarbonate)
- Dexilant (dexlansoprazole)
- Prilosec (omeprazole)
- Vimovo (esomeprazole and naproxen)
The association between PPIs and kidney injury was so strong that the U.S. Food & Drug Administration (FDA) issued a warning about the problem in December 2014. Specifically, FDA warned about the risk of acute interstitial nephritis (AIN), an inflammation of the kidneys that can lead to CKD if untreated.
Mullen’s complaint was filed on August 26, 2016 in the U.S. District Court for the Eastern District of New York. Plaintiff is seeking in excess of $10 million in damages.
