Nexium Lawsuit Filed in Louisiana

A woman who claims the heartburn medication Nexium (generic: esomeprazole) caused her to develop kidney failure has filed a products liability lawsuit against AstraZeneca in the U.S. District Court for the Eastern District of Louisiana.

What’s the problem?

The complaint was filed by Alice Donald, who alleges that AstraZeneca failed to warn the public and medical community about the potential health risks of Nexium before bringing it to market. According to the lawsuit, Donald took Nexium as recommended from September 2013 to April 2016, which caused her to develop kidney failure.

Nexium and other proton pump inhibitors (PPIs) work by reducing hydrochloric acid in the stomach and magnesium levels in the body, which could deprive the kidneys of vital minerals. PPIs may also damage the kidneys by causing recurrent inflammation over time.

Several recent studies have linked long-term Nexium use to an increased risk for acute interstitial nephritis (AIN), chronic kidney disease (CKD) and kidney failure (end-stage renal disease or “ERSD”).

Alice’s lawsuit alleges that the manufacturer was aware of the risk of kidney injuries with Nexium since at least 2004, but failed to disclose this information in an effort to maximize profits.

“Defendants knew or should have known about the correlation between the use of Nexium and the significantly increased risk of CKD and acute kidney injuries,” the complaint states. “Despite clear knowledge that Nexium causes a significantly increased risk of CKD and acute kidney injuries, Defendants continued to market and sell Nexium without warning consumers or healthcare providers of the significant risks of CKD and acute kidney injuries.”

In an Order issued March 22, the judge overseeing the case upheld claims of defect in construction or composition and design defect, ruling that Donald had sufficiently pled that Nexium was defective in formulation and that there were other safer heartburn medications available on the market. Plaintiff’s failure-to-warn claim was also upheld by the judge.
