What’s the Problem?
This recall affects model number EM003 of the Massimo Percussion Massage Gun, according to the U.S. Consumer Products Safety Commission (CPSC).
“Massimo has received three reports of fires with the recalled massage guns that resulted in over $15,000 in property damage,” CPSC said. “No injuries have been reported.”
The percussion massage guns have 20-speed levels and come with 6 massage heads and a built-in rechargeable lithium-ion battery. They were sold in black, silver, gold, and blue.
The recalled massagers were sold exclusively online at Costco.com from April 2020 through May 2020 for about $60.
If you purchased a massage gun that is affected by this recall, you should stop using it immediately and contact Massimo for a full refund.
This recall began on January 6, 2021.
Amazon, Theragun File Lawsuit Against Counterfeit Massage Devices
In June 2023, Amazon and Therabody filed a lawsuit against a group of individuals and Chinese corporations that allegedly marketed, sold, and distributed counterfeit Therabody products. The counterfeit operation, which took place between June and November 2022, caused both Amazon and Therabody to spend significant funds attempting to investigate the scam, according to the lawsuit.
“Defendants unlawfully advertised, marketed, offered, distributed, and sold products bearing counterfeit and infringing versions of the Therabody Trademarks with the intent and likelihood of causing customer confusion, mistake, and deception as to the products’ source, origin, and authenticity,” the complaint states. “Specifically, Defendants intended customers to believe, incorrectly, that the products originated from, were affiliated with, and/or were authorized by Therabody and likely caused such erroneous customer beliefs.”
This case highlights concerns about massage guns infringe on intellectual property rights. Therabody is requesting injunctive relief and the confiscation of all infringing products and materials as well as damages being awarded to both Therabody and Amazon. Both companies are also asking for attorney’s fees to be paid by the defendants.
