What’s the Problem?
April 11, 2017 – It stands to reason that J&J would try to settle as many Levaquin lawsuits as possible, to avoid a lengthy trial the company would likely lose anyway. Many claimants have already received settlements, and avoided having to be in a courtroom for an interminable period for a jury trial.
In 2004, the labeling of all antibiotics from the fluoroquinolone class were updated with a warning about peripheral neuropathy. However, plaintiffs allege that these warnings were improperly worded, indicating that risk of the disease was very low.
The U.S. Food & Drug Administration (FDA) in 2013 required that the warning be changed to indicate that nerve damage from fluoroquinolones could be permanent. FDA also required manufacturers to remove wording that indicated the condition was only a rare side effect.
However, in the 9 years between warnings, thousands of people had taken Levaquin and been injured by its side effects.
In addition to Levaquin, peripheral neuropathy lawsuits are being filed against the makers of other fluoroquinolone antibiotics including:
- Cipro (ciprofloxacin)
- Cipro Extended-Release (ciprofloxacin extended release)
- Avelox (moxifloxacin)
- Ofloxacin (generic brand)
- Factive (gemifloxacin)
