What’s the Problem?
J&J has been sued by thousands of plaintiffs in New Jersey and elsewhere who have claimed that talcum powder causes cancer. To date, the company as won and lost these jury trials, respectively.
When Verona resident Stephen Lanzo developed mesothelioma, he had a hunch that his development of the disease might have something to do with his use of Johnson’s Baby Powder, which had been using for more than 3 decades. He and his wife Kendra filed a lawsuit against J&J which they ended up winning, netting the couple a $117 million award last April. The case is significant because they were the first plaintiffs to emerge victorious over J&J regarding claims its talcum powder contains asbestos.
One document uncovered during the investigation was a 1969 note from a supply officer at J&J, who acknowledged it was “normal to find different levels of tremolite in many Americans talcs,” and questioned “… how bad the tremolite is medically, how much can be safe in a talc base that we could develop?”
In 1973, the Director of the Central Research Laboratory at J&J planned to acquire a patent on a process to eliminate talc tremolite, but in a later note, the company “… may wish to keep everything secret. To allow it to be published, in the form of a patent and thus let the world know. “
J&J continues to maintain that its talc-based products are completely safe and have contained no asbestos for decades.
