What’s the Problem?

June 29, 2016 – The conference was initially set for March 2016, but was postponed to allow the defendant’s attorneys more time to confer with their clients and to review the medical literature on vena cava filters.

The devices have been named in hundreds of lawsuits against manufacturers in courts across the U.S. Approximately 250 complaints have been filed over Cook IVC filters, which were formed into a multidistrict litigation (MDL) in the Southern District of Indiana. Trials in that MDL are scheduled to begin in September 2016.

IVC filters are small, cage-like medical devices that are implanted in patients who are unable to take traditional blood-thinner medications. The filters are placed in a patient’s inferior vena cava vein to catch blood clots from the lower body before they reach the heart and lungs. If a clot becomes trapped in the heart or lungs, then a pulmonary embolism (PE) may result. Vena cava filters are intended to be used on a temporary basis until the PE threat has subsided.

Plaintiffs in IVC filter lawsuits allege that the devices are defective and can fracture after being implanted, with the legs or “struts” then migrating to the heart, lungs or other body parts. The broken struts can also puncture veins or get stuck in internal organs and intestines, according to the complaints.

Emergency hospitalization has been required in many IVC filter recipients, and often times the pieces cannot be removed due to their migration to “high risk” parts of the body. If the pieces are unable to be extracted, they are left in the body with the potential to cause further damage and long-term health complications.
