J&J Wants Invokana Lawsuits Transferred to New Jersey

Janssen Pharmaceuticals is seeking to move over 100 product liability lawsuits alleging kidney failure and diabetic ketoacidosis (DKA) associated with Invokana (generic: canagliflozin) from the Philadelphia Court of Common Pleas to federal court in New Jersey.

What’s the Problem?

December 1, 2016 – Plaintiffs’ counsel proposed that the Invokana lawsuits be consolidated and tried together as part of a mass tort proceeding in state court; however, Janssen has pointed to the Class Action Fairness Act (CAFA) as the basis for removal to federal court. Plaintiffs have said they plan on filing a response in federal court challenging the removal.

A notice filed in Portnoff v. Janssen Pharmaceuticals said the case was one of 106 lawsuits that Janssen sought to remove to federal court in accordance with CAFA. According to the motion, the reason for that act is to ensure federal courts can try interstate cases of national importance.

Janssen’s move follows a request by plaintiffs to consolidate the litigation into a mass tort program. In September, the plaintiffs filed a petition to consolidate at least 87 Invokana lawsuits pending in the Philadelphia Court of Common Pleas. They said the number of cases filed should at least double in the coming weeks and months. The petition said the claims are virtually identical, and consolidation would streamline the litigation process.

The lawsuits allege that Invokana causes kidney failure and diabetic ketoacidosis, and that Janssen failed to adequately warn of these risks. Additionally, the suits contend that Invokana was defectively designed because it prevents the body from metabolizing excess glucose by causing it to be excreted through the urine.
