January 22, 2013 – Last week, a Texas woman filed a lawsuit against Fresenius Medical Care (FMC) alleging that its dialysis treatment products GranuFlo and NaturaLyte caused her husband to suffer a fatal heart attack. The new complaint is just the latest in a wave of similar litigation alleging that FMC failed to adequately warn the public and medical communities about the potential health risks involved with using their dialysis products. According to the lawsuits, NaturaLyte and GranuFlo convert to bicarbonate in the human bloodstream at a rate much greater than rival products, which can lead to adverse cardiovascular side effects.

GranuFlo / NaturaLyte Lawsuit Update 3/12/13: At least four separate GranuFlo and NaturaLyte class action lawsuits have been filed against DaVita Healthcare, alleging that the company should have known about the dialysis products’ potential to cause severe, potentially life-threatening side effects. What’s the problem?
The new GranuFlo / NaturaLyte lawsuit was filed by Emma Hernandez on January 14 in the U.S. District Court for the District of Massachusetts on behalf of her deceased husband, Santos Pena Hernandez. According to the complaint, Mr. Hernandez died on January 17, 2011, after suffering a heart attack following dialysis treatment involving NaturaLyte or GranuFlo.
Hernandez, 68, underwent hemodialysis treatment at the Kidney Disease Associates Dialysis Center on January 16, 2011. Soon after the treatment was over, he told his wife that he felt ill and bloated. The next morning at 2:30 a.m., Hernandez woke up complaining of a headache, then clutched at his heart and began spitting up saliva. Emma promptly called 911, but Santos was dead before paramedics could arrive.
“Mr. Hernandez’s injury and death, like those striking thousands of similarly situated victims across the country, were avoidable tragedies,” the lawsuit states. “GranuFlo and NaturaLyte have been implicated in a national epidemic of deaths of dialysis patients.”
The GranuFlo / NaturaLyte lawsuit accuses FMC of:
- negligent misrepresentation
- strict liability
- failure to warn
- breach of warranty
- deceptive trade practices
- wrongful death
The complaint seeks compensation for:
- mental anguish
- economic losses
- the value of Santos Hernandez’s life including expected income, services, protection, care, comfort and companionship
In response to the growing number of lawsuits filed over GranuFlo and NaturaLyte side effects, a motion has been entered to consolidate all such claims filed on the federal level before one judge in a multidistrict litigation (MDL). Consolidation is intended to reduce duplicative discovery, avoid conflicting rulings from different judges, and to serve the convenience of all parties involved in the litigation process. The U.S. Judicial Panel on Multidistrict Litigation (JPML) is expected to hear oral arguments regarding the motion in March 2013.
