March 12, 2013 – At least four separate GranuFlo and NaturaLyte class action lawsuits have been filed against DaVita Healthcare, alleging that the company should have known about the dialysis products’ potential to cause severe, potentially life-threatening side effects. GranuFlo and NaturaLyte, which were manufactured and sold by Fresenius Medical Care (FMC), have been linked to an increased risk of heart attack and sudden death during hemodialysis treatment. The products were widely used at DaVita clinics, which competed directly with FMC clinics, before being recalled nationwide in March 2012.

Side Effects of GranuFlo & NaturaLyte
It has recently come to the public’s attention that both GranuFlo dry acid concentrate and NaturaLyte liquid concentrate contain sodium acetate, which allegedly converts to bicarbonate at a much higher rate than rival dialysis treatment products. In response to these findings, a nationwide recall was issued for NaturaLyte and GranuFlo on March 29, 2012.
Fresenius not only manufactures and markets GranuFlo and NaturaLyte, but it also owns and operates thousands of dialysis treatment centers around the country that compete with DaVita clinics. A 2011 internal review of patients at FMC clinics identified at least 941 individuals who suffered cardiac arrest while being treated with GranuFlo or NaturaLyte. Plaintiffs in the class action lawsuits claim that DaVita officials should have understood the risks associated with the products before they were recalled.
“DaVita knew, or was negligent in not knowing, that its patients’ pre-dialysis serum bicarbonate levels were gradually increasing and that patients were at an increased risk of cardiac arrest as a result,” the lawsuits state. “There were several things DaVita could and should have done, but did not do, to protect its patients.”
To date, dozens of individual GranuFlo and NaturaLyte lawsuits have been filed against FMC in courthouses around the country, alleging that the company failed to adequately warn the public and medical communities about the risks associated with the products. As of February 12, nearly 60 complaints were pending against FMC nationwide, and a motion has been filed to consolidate the claims into a multidistrict litigation (MDL) for pretrial handling. Industry insiders have predicted that the company could ultimately face thousands of injury and wrongful death lawsuits.
