A parent is suing the Gilroy Unified School District (GUSD) for not firing a teacher who allegedly sent out sexually explicit text messages to an underage girl. Douglas Le was arrested on 2 counts of child enticement last week, but police say the texting started back in 2014.

What’s the Problem?
May 6, 2016 – The complaint accuses GUSD of negligence and inflicting emotional distress on the daughter of Celest Benn, who was a student at Gilroy High School. She allegedly received a number of inappropriate text messages from Le in Oct. 2014. Celest says she notified school officials the day after she learned about the texts, but they initially refused to meet with her.
In a written statement, GUSD said Le’s behavior was unprofessional and unacceptable, but there was no evidence of criminal activity that required dismissal. The school district did issue a notice of unprofessional conduct; however, there was no indication of “catfishing” — a term used to describe a man posing online as a woman to engage with underage boys — and there were no further complaints.
“They protected an individual who admittedly engaged in gross sexual misconduct, and because they failed to take meaningful actions, many more children were harmed,” Benn said.
Gloria Allred, one of the nation’s most high-profile attorneys, is representing the family in the case. The lawsuit accuses GUSD authorities of failing to protect children from Le, and seeks a jury trial for damages against the district for negligence, sexual harassment, gender violence and other accusations.
