What’s the Problem?
March 15, 2017 – The JPML said the Taxotere litigation included docetaxel in its formal title, suggesting the MDL involved lawsuits against both name-brand and generic forms of the drug.
The panel’s letter was in response to District Judge Kurt D. Engelhardt, who wrote to the panel for clarification in December. Judge Engelhardt is overseeing the Taxotere MDL, which was consolidated in October in the U.S. District Court for the Eastern District of Louisiana.
The lawsuits accuse Sanofi S.A. and other generic manufacturers of designing a defective medication and failing to adequately warn the public and medical community about the risk of permanent hair loss.
Plaintiffs further allege that Taxotere is more likely to cause permanent alopecia than equally effective chemo drugs on the market, and that Sanofi warned about this risk in other countries, including Canada and the European Union. In the U.S., however, the drug’s labeling merely states that “hair generally grows back” after chemotherapy with Taxotere is complete.
The Taxotere MDL added 50 more lawsuits between January and February, according to JPML’s Multidistrict Litigation Statistics Report. That’s after the litigation nearly tripled from December to January, jumping from just over 260 lawsuits to more than 700.
As of mid-February, there were at least 755 Taxotere lawsuits pending in the MDL.
