Fresh Garden Highway Salad Recall Lawsuit

A Deerfield, N.J. establishment is now recalling nearly 400 pounds of Cobb and spinach salads because they contain eggs that are the subject of a nationwide listeria food poisoning recall. What’s the problem?

February 3, 2012 – The U.S. Department of Agriculture’s Food Safety and Inspection Service (FSIS) announced today that F&S Produce Company Inc. is recalling the following products because they have the potential to be contaminated with Listeria monocytogenes:

  • 10-oz. plastic containers of “Fresh Garden Highway Spinach Salad with Bacon”
  • 10.75-oz plastic containers of “Fresh Garden Highway Cobb Salad”

These salads have a ‘Sell By’ date through 2/8/2012, and can be identified by the establishment number ‘Est. 39897’ in addition to the USDA mark of inspection.

The problem was discovered when F&S Produce was notified that hard-cooked eggs from one of its suppliers, Michael Foods Egg Products Co., had tested positive for Listeria monocytogenes. The salads being recalled contain the potentially contaminated eggs. To date, there have been no illnesses reported in connection with this recall.

Listeria Food Poisoning (Listeriosis)

Consumption of food contaminated with the bacterium Listeria monocytogenes can cause listeriosis, a rare but but potentially life-threatening foodborne illness. Healthy adults rarely contract listeria food poisoning. However, the illness has been known to cause the following side effects in children, the elderly, and those with compromised immune systems:

  • high fever
  • severe headache
  • neck stiffness
  • nausea
  • diarrhea
