What’s the Problem?

January 9, 2017 – According to the lawsuit (PDF), Plaintiff was implanted with the Ethicon Physiomesh patch (Catalog No. PHY1520V, 15 X 20 cm) while undergoing laparoscopic ventral hernia repair in February 2016.

Complications of the allegedly defective mesh required her to have hernia revision surgery in August 2016, during which it was discovered that she had an abdominal bulge, recurrent hernia, pain and adhesion.

Ethicon withdrew certain Physiomesh devices from the global market in May 2016, after an analysis of unpublished data found higher than average recurrence and reoperation rates following laparoscopic ventral hernia repair with the products. The catalog number cited in the Florida Physiomesh lawsuit, PHY1520V, is among those listed in the withdrawal notification.

Plaintiff alleges that Physiomesh is not reasonably safe for its intended use, and that risks of the design outweigh any potential benefits. The complaint was filed on Dec. 27, 2016, in the U.S. District Court, Middle District of Florida under case number 8:16-cv-03502-JDW-JSS.

Court records indicate that the first Physiomesh lawsuit (Case No. 3:16-cv-00368-JPG-PMF) is scheduled to go to trial in the U.S. District Court, Southern District of Illinois, in January 2018.
