What’s the problem?
October 2, 2017 – Plaintiff is the new lawsuit claims that the Optetrak knee was designed defectively, and that Exactech knew about the problems and actually took action to conceal this knowledge from the public and medical community in an effort to maximize profits.
The problem with the Exactech knee, according to the lawsuit, is the device’s unique finned tibial tray design, which does not properly adhere to the patient’s bone. This can cause loosening, instability, pain, infections, knee implant failure and the need for revision surgery.
Exactech In 2010 reached a settlement agreement with federal prosecutors for $3 million as a result of kickbacks given to orthopedic surgeons, according to Law360. Three years later, the company recalled a number of hip and shoulder replacement devices due to incorrect and transposed product labeling.
The Gainesville, Fla.-based company also agreed to an accompanying settlement, in which it agreed to pay $2.99 million to settle civil and administrative claims without any admitting any wrongdoing.
The new Optetrak knee lawsuit, which was filed on September 27, 2017, was the first lawsuit in Georgia to bring allegations against Exectech over the Optetrak knee.
