What’s the Problem?
October 8, 2016 – The California Essure lawsuits will be heard together as Judicial Council Coordinated Proceedings (JCCP), which will facilitate efficient adjudication and coordinate efforts on behalf of the plaintiffs, according to Superior Court Judge Winifred Y. Smith.
Prior to the consolidation, there were at least 55 lawsuits filed by some 900 women in California who claim they suffered complications after being implanted with the device. The complaints allege that Essure has caused numerous problems and physical injuries in thousands of women who have received the contraceptive.
In February, the U.S. Food & Drug Administration (FDA) announced that it would require Bayer to include a “black box” warning on Essure’s labeling “designed to call attention to serious or life-threatening risks.” FDA also ordered Bayer to conduct additional safety studies in order to better understand the health risks associated with it, including removal of the contraceptive.
In addition to the newly-formed coordination of Essure lawsuits in California, Plaintiffs’ lawyers have asked the U.S. Judicial Panel on Multidistrict Litigation (JPML) to form a multidistrict litigation (MDL) for lawsuits alleging injuries from Essure, according to Reuters. In a motion filed in July, the lawyers asked to consolidate 30 such complaints filed on behalf of over 1,000 women before U.S. District Judge Gerald McHugh in the Eastern District of Pennsylvania. McHugh is already handling 3 lawsuits over the device.
