Essure Class Action Lawsuit Allowed to Proceed in Philadelphia Court

April 3, 2019 – A federal judge in Philadelphia will allow 6 women who have filed lawsuits against Bayer AG over injuries alleged from its Essure birth control device to proceed with their personal injury claims, and 3 others to pursue breach-of-warranty suits.

Bayer had requested a partial summary judgment on all 12 plaintiffs involved in the class action, citing statutes of limitations. Judge John Padova from the Eastern District of Pennsylvania approved the motion on the personal injury claims of 6 of the women, and on some or all of the breach-of-warranty claims of 9 women.

What’s the problem?

One of the women who filed suit against Bayer became pregnant following implantation with Essure; the judge allowed her to pursue her claim that the company fraudulently concealed the risk of pregnancy.

All plaintiffs in the class action underwent surgery with Essure coils between 2006 and 2013, and subsequently claimed to have developed a variety of severe health complications. Side effects reported by the women included pain, bleeding and autoimmune disorders. Two of the women also became pregnant, according to Reuters.

Regardless of the outcome of these particular suits, Bayer still faces thousands of complaints filed by women who claim the Essure IUD pierced their fallopian tubes, and that part of the device became dislodged and migrated to other parts of their bodies.

Bayer announced in July that it would phase out Essure (not classified as a recall) in the U.S., a move the company blamed on decreased sales rather than health concerns.
