Drugmakers top list of DOJ fraud settlements
October 25, 2010 – According to a recent report by the advocacy group Taxpayers Against Fraud Education Fund, the pharmaceutical industry is now the number one source of fraud-related settlements with the U.S. Department of Justice (DOJ), representing eight of the government’s top 10 settlements related to fraud over the past year.
Among the highlights of the report: drugmaker Allergan Inc. paid out $600 million to settle allegations that it marketed Botox for unapproved uses. AstraZeneca paid $520 million over allegations of inappropriate marketing of its psychiatric drug Seroquel. Other companies in the top 10 include Novartis Pharmaceuticals, Forest Laboratories, and Teva Pharmaceuticals.
Despite the slew of seemingly enormous payouts by drugmakers in recent years, industry experts and public health advocates say steeper penalties are needed to reign in pharmaceutical industry behavior. They point out that multimillion dollar penalties typically represent a very small fraction of total sales.
