Iovate to Pay $1.5M Over Dietary Supplement False Advertising

The Canadian firm that manufactured the notorious diet drug Hydroxycut has been ordered to pay $1.5 million to settle 10 lawsuits over deceptive advertising of its questionable dietary supplements.

What’s the problem?

January 16, 2012 – According to Courthouse News, Canadian-based Iovate Health Systems and its U.S. affiliate were sued by 10 California district attorneys alleging the company made false and misleading claims about the following so-called ‘dietary supplements:’

  • Accelis
  • nanoSLIM
  • Cold MD
  • Germ MD
  • Allergy MD
  • EZ-Swallow

Iovate was also accused of being in violation of Californian statute Proposition 65, the Safe Drinking Water and Toxic Enforcement Act of 1986, because samples of Cold MD (which was on the market as an unapproved drug prior to being pulled by the company) were found to contain more than the permitted 0.5 micrograms of lead per daily dose.

The lawsuits sought $1.2 million in civil penalties and $300,000 in investigative costs. Iovate, which refused to admit guilt in the matter, reluctantly agreed to abide by court orders and pay the fine.

“The Sonoma County District Attorney’s Office is committed to working with prosecutors throughout California to protect our citizens from deceptive advertising and potentially harmful products,” said Sonoma County district attorney Jill Ravitch.
