DePuy Pinnacle hip injury lawsuits continue to be filed in courthouses around the country, with more than 3,200 cases currently consolidated in the federal multidistrict litigation (MDL) for pretrial proceedings. According to the vast majority of the complaints, the Pinnacle’s design is inherently flawed, and allows microscopic metal particles to enter the bloodstream as the device’s components rub together. Over time, this design defect has been found to lead to a form of blood poisoning known as metallosis, which can increase the risk of inflammation and loosening of the components.

What’s the problem?
Unlike the more widely publicized problems with the DePuy ASR synthetic hip device, much less attention has been focused on the Pinnacle, which is an older metal-on-metal hip implant that has also been linked to numerous reports of early failure, which have resulted in the need for corrective surgery to have the device removed.
In August 2010, DePuy issued a nationwide recall for approximately 93,000 ASR hip implants, after the model was repeatedly shown to fail within just a few years of being implanted.
The ASR was approved by the U.S. Food & Drug Administration (FDA) under the controversial ‘510K loophole’ because it was shown to be ‘substantially similar’ to the Pinnacle, which also features a metal-on-metal design. However, DePuy never issued a recall for the Pinnacle, and many recipients of the artificial hip who suffered injuries after undergoing surgery are unaware that their problems may have been caused by the device.
All DePuy Pinnacle hip injury lawsuits filed in federal courthouses around the country have been consolidated into an MDL before Judge Ed Kinkeade in the Northern District of Texas. At the time the litigation was consolidated, there were less than 60 cases pending nationwide. However, that number has skyrocketed in recent months, with more than 3,200 cases currently centralized in the MDL. The first of these lawsuits are scheduled to go to trial in September 2014.
