DePuy Hip Update 1/23/13: Newly disclosed court documents have revealed that a 2011 internal investigation conducted by Johnson & Johnson on its much-troubled DePuy ASR hip implant estimated that the device would fail within five years in nearly 40% of recipients. November 19, 2010 – Due to numerous emerging reports and gathering evidence, it seems increasingly likely that DePuy employees and officials knew of the potential and real defects in the company’s ASR hip replacement systems years before they were recalled. Indeed, long after doctors and patients had discovered a nearly 1-in-8 failure rate within the first 5 years of receiving the hip replacement implants, DePuy kept selling them. Even after the company removed the product from the Australian market, it continued selling them in the U.S. and elsewhere around the world.
It wasn’t until August 2010 that DePuy announced a recall on both the ASR XL Acetabular System and the ASR Hip Resurfacing System. TheDePuy Hip Replacement Recall was largely due to fact that many recipients of these devices required revision surgery. These revision surgeries are expensive and recovery can be as or more difficult than recovery from the initial hip surgery.
Approximately 93,000 hip replacement units were affected by the recall. Now, patients who have had their DePuy hip replacements fail have filed lawsuits against the company, saying they have had to undergo revision surgery because of the defective hip replacement. Such lawsuits allege that patients experienced failure of their hip replacements within five years of receiving the replacement.
