Motion Filed to Centralize DePuy ASR Recall Lawsuits in MDL
September 15, 2010 – A motion has been filed with the U.S. Judicial Panel on Multidistrict Litigation to consolidate and centralize all federal DePuy ASR hip replacement lawsuits in one court for coordinated pretrial proceedings. If approved, the consolidation could eventually impact thousands of cases that are likely to be filed throughout the country on behalf of individuals injured by a defective artificial hip implant.
Johnson & Johnson announced the recall of the DePuy ASR Hip Implant system after data from the National Joint Registry of England and Wales showed that 1 out of every 8 patients (12%-13%) who had received the recalled devices had to undergo revision surgery within five years of receiving it. The recall involved the ASR XL Acetabular System, a hip socket used in traditional hip replacement, and the ASR Hip Resurfacing System, a partial hip replacement that involves placing a metal cap on the ball of the femur. Only the ASR XL Acetabular System was approved for use in the United States.
While a handful of hip implant lawsuits were filed prior to the recall, the litigation is expected to increase dramatically. Doctors are currently encouraging all patients to return for an examination to determine whether the hip replacement is functioning as it is supposed to. Additionally, patients will likely require treatment to monitor for problems in the future.
DePuy Hip Update 1/23/13: Newly disclosed court documents have revealed that a 2011 internal investigation conducted by Johnson & Johnson on its much-troubled DePuy ASR hip implant estimated that the device would fail within five years in nearly 40% of recipients.
