What’s the problem?

September 21, 2010 – Last month, Johnson & Johnson’s Depuy Orthopedics announced a worldwide recall of its popular hip replacement devices. As many as 93,000 people around the world may be affected by the Depuy ASR Hip Recalls. Law firms around the U.S. have brought class action lawsuits against the company on behalf of patients who have received these hip replacements. Many of the plaintiffs claim that the company had prior knowledge of the defects inherent to the hip replacements years before the Depuy ASR Recalls.

According to the company website, DePuy promises to “cover reasonable and customary costs of testing and treatment, including revision surgery if it is necessary, associated with the ASR recall.” Additionally, DePuy said it would “process other reasonable out-of-pocket costs, such as lost work time and travel expenses, which may be reimbursed.”

It is widely believed that adequate testing of the DePuy ASR hip by Johnson & Johnson would have revealed the defects with the device and saved many of these patients from hip revision surgeries, hip complications, and pain. Patients around the country have suffered complications after being implanted with this defective device. Affected individuals should seek every measure of damages allowed by law in these cases to hold the manufacturer accountable.

DePuy Hip Update 1/23/13: Newly disclosed court documents have revealed that a 2011 internal investigation conducted by Johnson & Johnson on its much-troubled DePuy ASR hip implant estimated that the device would fail within five years in nearly 40% of recipients. For reasons still unclear, the company failed to make this information public while simultaneously downplaying the potential health complications associated with its metal-on-metal hip.
