A growing number of firms around the country have been making deceptive and illegal disease prevention claims about immunity, according to the Center for Science in the Public Interest (CPSI). Unfortunately, many consumers interpret immunity claims to be a promise of disease prevention, when in fact this is almost never the case. What’s the problem?
March 13, 2012 – According to the CSPI, direct selling giant Amway is one of the largest firms currently making deceptive claims about dietary supplement products. The center has reportedly informed Amway that it intends to take legal action against the company unless it changes ‘unsubstantiated claims’ about its Nutrilite liquid dietary supplements.
Specifically, CSPI believes the assertion that the Nutrilite Immunity twist tube is an immune booster that protects your cells is unlawful “because it implies the product will prevent disease. It won’t”.
CSPI also argues that Amway’s Nutrilite fruits and vegetables 2GO Twist Tubes falsely claim to provide the same health benefits as whole fruits and vegetables. “Dietary supplements simply do not provide the same health benefits as a diet rich in whole fruits and vegetables.”
Amway is one of the world’s largest direct sell businesses, offering products in more than 80 countries via over three million distributors. According to the company’s website, Nutrilite is the world’s best-selling vitamin and dietary supplement brand.
According to CSPI litigation director Stephen Gardner, “Lots of firms make immunity type claims, and almost all of them are deceptive claims or illegal disease-prevention claims.”
Gardner believes the main problem with Amway’s marketing of these products is the word ‘immunity.’ “Many consumers interpret an immunity claim to be a promise of disease prevention.”
Amway is not the only company that has been accused of making deceptive claims about its products lately. Baby food manufacturer Gerber was recently warned by the National Advertising Division of the Council for Better Business Bureaus (NAD) for using the phrase ‘natural immune support’ on its products, while Kellogg was disciplined by the FTC for claiming that Rice Krispies ‘help support your child’s immunity.’ Bayer, Nestle and Dannon have also come under close scrutiny over product marketing claims in recent years.
