Cook IVC Filter Settlement Conference Unsuccessful at Resolving Complaints

A settlement conference has been called with the hopes of resolving almost 500 lawsuits in MDL No. 2570.

A settlement conference intended to resolve nearly 500 lawsuits pending in the Cook IVC filter multidistrict litigation (MDL) in the Southern District of Indiana was unsuccessful at settling any claims. Bellwether trials in the litigation are scheduled to begin early next year.

What’s the Problem?

August 17, 2016 – According to court order issued June 29, attorneys for both sides of the Cook IVC filter litigation gathered to discuss potential settlement agreements with U.S. Magistrate Judge Tim Baker, but were unable to find common ground and concluded “without further order.”

There may be other attempts to settle cases, but if these also fail the bellwether trials will proceed next year. These trials are intended to determine how juries are likely to respond to the evidence, and after they are concluded, the 2 sides may be in a better position to reach an agreement. If not, all cases in the MDL will be remanded to their original courts for individual trials.

The upcoming bellwether trials are:

  • Hill v. Cook Medical, Inc. et al., Case No. 1:14-cv-60616 (Cook Celect)
  • Brand v. Cook Medical, Inc. et al., Case No. 1:14-cv-6018 (Cook Celect)
  • Gage v. Cook Medical, Inc. et al., Case No. 1:14-cv-1875 (Günther Tulip)

IVC Filter Complications

In May 2014, the U.S. Food & Drug Administration (FDA) issued a safety communication warning that IVC filters should be removed between 29 and 54 days after implantation, as long as the danger of pulmonary embolism had passed. Complications associated with the devices include:

  • Fracture of the IVC Filter
  • Perforation, Puncture or Serious Damage to the Heart, Lungs or Vena Cava
  • Internal Bleeding
  • Cardiac or Pericardial Tamponade
  • Ventricle Tachycardia
  • Lower Limb DVT
  • Hematoma or Nerve Injury at the Puncture Site
  • Constant and Severe Pain in the Heart, Chest or Elsewhere in the Body
  • Pulmonary Embolism
  • Infection
  • Death
