Tennessee Man Files Lawsuit Over Cook IVC Filter Complications

A man from Tennessee who was allegedly injured after receiving a vena cava filter made by Cook medical has filed a lawsuit seeking compensation for his injuries.

What’s the Problem?

June 20, 2016 – According to the lawsuit, Plaintiff Robert Douglas Debord was implanted with a Cook Günther Tulip IVC filter at Wellmont Health System in Kingsport, Tennessee on November 22, 2006. The Günther Tulip was approved by the U.S. Food & Drug Administration (FDA) in 2000 for permanent placement and then in 2003 for temporary placement; the device was marketed as a revolutionary solution for patients in need of close management and control over thromboembolic disease. However, IVC filters have been linked to reports of adverse health complications including device migration, organ perforation, hemorrhages, blood clots, respiratory compromise and death.

In April 2012, a study published in Cardiovascular and Interventional Radiology reported that 100% of Gunther Tulip and Cook Celect IVC filters perforated patients’ venal cava wall in less than 3 months after being implanted. The study also reported that 40% of the filters were tilted and out of position.

Debord accuses Cook Medical of negligence for selling a defective medical device, failure to warn about potential complications, and breaching both implied and express warranties. The lawsuit was entered today in the Cook IVC Filter multidistrict litigation (MDL No. 2570) in Indiana under case number 1:16-cv-01518-SEB-MJD. All complaints in the MDL involve similar allegations that manufacturing defects with Cook vena cava filters make the devices likely to fracture, migrate and puncture internal organs.
