Federal Cook IVC Filter Lawsuits Consolidated into MDL

The U.S. Judicial Panel on Multidistrict Litigation (JPML) has ruled that all federal lawsuits involving Cook vena cava filters will be centralized in the Southern District of Indiana for pretrial proceedings. Update: Cook IVC Filter Settlement Conference Unsuccessful at Resolving Complaints

August 17, 2016 – A settlement conference intended to resolve nearly 500 lawsuits pending in the Cook IVC filter MDL was unsuccessful at finding common ground, according to a court order issued June 29. There may be other attempts to settle cases, but if these also fail the bellwether trials will proceed next year.

What’s the Problem?

The nationwide multidistrict litigation (MDL) will be overseen by U.S. District Judge Richard L. Young, and include all product liability and personal injury lawsuits involving complications allegedly caused by Cook IVC filters. According to the Transfer Order, there are at least 32 complaints currently pending in various jurisdictions involving Cook Celect and Gunther Tulip inferior vena cava filters. MDLs are commonly established in complex product liability litigation to reduce discovery, avoid conflicting rulings from different judges, and to serve the convenience of the parties.

IVC Filter Medical Studies

An April 2012 study published in Cardiovascular Interventional Radiology found that 100% of Cook Celect and Gunther Tulip IVC filters perforated patients’ vena cavas within 71 days of being implanted. The researchers also determined that 40% of the devices were tilted and out of position. A year later, a JAMA Internal Medicine study found that less than 10% of IVC filters were successfully removed, and 8% of patients suffered a pulmonary embolism despite the devices’ presence.

Cook IVC Filter Bellwether Trials to Begin in 2017

August 11, 2016 – The federal judge overseeing the Cook IVC filter multidistrict litigation (MDL) in the Southern District of Indiana has scheduled 3 bellwether trials to begin next year. The bellwether trials will set the bar for hundreds of other similar complaints alleging complications from Cook IVC filters. The 3 cases selected by Judge Richard L. Young allege a number of injuries caused by the Cook Celect and Günther Tulip filters.
